A shocking road rage incident unfolded on Erskine Avenue in Peterborough, Ontario, when a pickup truck driver attacked a 74-year-old cyclist with a club.
The violent encounter was captured on video by a local business owner and quickly went viral.
How It Started
“I saw him with that raised bat in his hand, I was like, oh my God, oh my God”
The video shows the 65-year-old driver, David Fox, assaulting the cyclist after an apparent argument, with a person confronting the driver stating, “you just hit him with a club”.
The cyclist was struck multiple times, bleeding profusely and sustaining facial and head injuries. Another witness described the severity of the attack, recalling, “He was coming at him, and coming at him hard. As soon as I saw him with that raised bat in his hand, I was like, oh my God, oh my God”.
Witnesses
Witnesses intervened to halt the assault, and the driver subsequently left the scene.
Peterborough police identified and arrested Fox at his residence shortly after the incident, charging him with aggravated assault and assault with a weapon.
Peterborough Police spokesperson Lauren Gilchrist explained the nature of the charges, stating, “According to the criminal code a charge of aggravated assault would apply when a person is either maimed, wounded, disfigured, or when the assault would involve endangering the life of that person”.
The two men were not known to each other. Fox was released from custody and was scheduled to appear in court during August 2017.
The Case Didn’t Go To Court
The case faced significant delays over four years due to Foxโs health and the COVID-19 pandemic.
Ultimately, the legal proceedings concluded when the charges against David Fox were formally withdrawn in Superior Court following his death in September 2021.
